These Terms of Use ("Terms") govern your access to and use of the Smart-Reader.ai website and services (the "Service"). By creating an account or using the Service you agree to these Terms.

1. Acceptance of terms

By accessing or using Smart-Reader, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms; continued use after changes constitutes acceptance.

2. Description of service

Smart-Reader provides AI-assisted guided reading, close-reading questions, vocabulary practice, and essay outline generation. The Service is provided on an "as is" and "as available" basis. We do not guarantee specific academic outcomes, and we may modify or discontinue features at our discretion.

3. Eligibility and accounts

You must be at least 13 years old to create an account. Users under 13 may only access Smart-Reader under a parent, guardian, or teacher account with appropriate consent. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Subscriptions, billing, and refunds

Smart-Reader is offered with a 14-day free trial. After the trial, a paid subscription is required to continue. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and no partial refunds are issued for unused time, except where required by law. Payments are processed by Stripe.

5. User content and license

You retain ownership of any text you paste or upload ("User Content"). You grant Smart-Reader a limited, worldwide, non-exclusive license to host, transmit, and process your User Content solely to provide the Service to you. We do not claim ownership and we do not authorize third parties to use your User Content to train their AI models.

6. Copyright and DMCA

You are solely responsible for ensuring you have the right to upload any text. Do not upload copyrighted material without permission. If you believe content on the Service infringes your copyright, send a notice including the items required by 17 U.S.C. § 512(c)(3) to dmca@smart-reader.ai. Repeat infringers will be terminated.

7. AI disclaimer

Smart-Reader uses artificial intelligence to generate questions, feedback, vocabulary, and outlines. AI output may be inaccurate, incomplete, biased, or otherwise inappropriate. Smart-Reader is an educational support tool, not a substitute for a qualified educator, tutor, or accredited curriculum. Always review AI output before relying on it.

8. Prohibited conduct

You may not (a) use the Service to generate harmful, illegal, defamatory, or infringing content; (b) attempt to reverse engineer, scrape, or overload the Service; (c) circumvent access controls; (d) use the Service to violate any applicable law or third-party right. Violation may result in immediate termination without refund.

9. Intellectual property

The Service, including its design, software, text, graphics, and the Smart-Reader name and logo, is owned by Smart-Reader.ai and protected by intellectual property laws. No rights are granted to you except as expressly set out in these Terms.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Smart-Reader.ai and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) US $50.

12. Indemnification

You agree to indemnify and hold Smart-Reader.ai harmless from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms.

13. Termination

We may suspend or terminate your access at any time for breach of these Terms or to comply with law. You may stop using the Service and delete your account at any time.

14. Governing law

These Terms are governed by the laws of the United States and the state in which the operator is domiciled, without regard to conflict of laws principles. Disputes shall be resolved in the state and federal courts of that jurisdiction.
